By using our website or entering a care arrangement with us, you agree to be bound by these terms.

Acceptance of Terms

By accessing this website or making an enquiry about our services, you confirm that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. If you are acting on behalf of another person, you confirm that you have the authority to do so.

Use of this website constitutes acceptance of these Terms and Conditions and our Privacy Policy. If you do not agree, please discontinue use of the website.

Service Description & Availability

helvorens operates a senior residential care facility in Bangkok, Thailand, offering three levels of residential care: Gentle Living, Attentive Living, and Complete Nursing Care. Full descriptions of each program are available on our website and in our care documentation provided at assessment.

Services are available to residents physically present at our Bangkok facility. We do not deliver remote or online care services. Availability of places is subject to capacity at the time of enquiry.

We reserve the right to modify, suspend, or discontinue any aspect of our services with reasonable notice, except where urgent circumstances require immediate action.

Admission & Care Agreements

Admission to helvorens requires a care assessment conducted by our nursing team and the signing of a formal care agreement by the resident (or their authorised representative) and helvorens. The care agreement sets out the specific services to be provided, the applicable monthly fee, billing arrangements, and the responsibilities of both parties.

These Terms and Conditions supplement the care agreement and apply in addition to it. In the event of a conflict between these Terms and the care agreement, the care agreement shall take precedence.

User Responsibilities

When using our website or communicating with our team, you agree to:

Residents and their authorised representatives agree to comply with facility policies communicated at admission, including visiting hours, conduct standards, and health protocols.

Intellectual Property

All content on the helvorens website — including text, photographs, logos, and design elements — is the property of helvorens or its licensors and is protected under applicable intellectual property law.

You are granted a limited, non-exclusive licence to access and view the website for personal, non-commercial purposes. You may not reproduce, distribute, modify, or use our content for commercial purposes without our written permission.

Payment Terms

Monthly residential care fees are billed in Thai Baht (฿) on a calendar-month basis. Payment terms are set out in the individual care agreement. Generally:

Fee adjustments, if any, will be communicated with at least 30 days written notice.

Care Services — Scope & Limitations

helvorens provides residential care services as described in the relevant tier documentation and the signed care agreement. Our services do not replace acute hospital care, specialist medical treatment, or surgical procedures, which must be arranged through appropriate external providers.

Care plans are reviewed regularly and adjusted in response to a resident's changing needs. Where a resident's needs exceed what can be safely delivered within our facility, we will communicate this clearly and work with the family to identify appropriate alternative arrangements.

Limitation of Liability

To the fullest extent permitted by Thai law, helvorens's liability to you arising from these Terms, the use of our website, or the provision of services shall be limited to the fees paid by you for the relevant service in the three months preceding the claim.

We are not liable for indirect, incidental, or consequential losses arising from your use of our website or services, including loss of data, loss of income, or third-party claims, except where such losses result from our negligence or wilful misconduct.

Indemnification

You agree to indemnify helvorens against any claims, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the website, or any inaccurate information you have provided to us. This obligation survives termination of any care agreement or website relationship.

Termination

Either party may terminate a care agreement by providing written notice as specified in the care agreement (typically 30 days). In cases involving safety concerns or serious breach of facility policies, helvorens may terminate the arrangement with shorter notice.

Upon termination, outstanding fees for services already provided become immediately due. Resident belongings will be made available for collection in a respectful and organised manner.

Governing Law & Dispute Resolution

These Terms and Conditions are governed by and construed in accordance with the laws of the Kingdom of Thailand. Any dispute arising from these Terms shall first be referred to informal resolution through direct communication with our management team.

If informal resolution is not achieved within 30 days, disputes shall be submitted to the jurisdiction of the courts in Bangkok, Thailand. We respect your consumer rights under Thai law, including rights under the Consumer Protection Act B.E. 2522.

Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. For existing residents, material changes will be communicated in writing with at least 30 days notice. Continued use of our website or services after changes become effective constitutes acceptance of the revised Terms.
